These Terms of Service ("Terms") are a binding legal agreement between you and ChienTech ("PullPilot", "we", "our", or "us"). By creating an account, downloading the app, installing the Chrome Extension, or otherwise accessing or using any part of the PullPilot service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use PullPilot.
We may update these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use after the effective date of any update constitutes your acceptance.
You must be at least 16 years old to use PullPilot. By using PullPilot you represent that you are at least 16. Users under 16 are not permitted to use PullPilot. By using PullPilot you represent that you have the legal capacity to enter into a binding agreement. At registration, you will be required to confirm your age via a checkbox. We do not knowingly permit users under 16 to create accounts. If we learn that an account holder is under 16, we will terminate the account in accordance with §12.
PullPilot is a crowdsourced automotive parts availability platform. Users can:
PullPilot is available as a web progressive web app (PWA) at pull-pilot.com, as iOS and Android mobile apps, and as a Chrome browser extension that operates on picknpull.com.
PullPilot is provided free of charge. No monetary consideration is required to access any features. We reserve the right to introduce optional paid features in the future with advance notice.
To access most features you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary to keep it accurate. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not create more than one account per person. PullPilot reserves the right to refuse registration or cancel accounts at its discretion.
You retain ownership of the content you submit to PullPilot (reports, photos, notes, bounties). By submitting content, you grant PullPilot a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to store, display, reproduce, modify (for technical formatting and accessibility), distribute, and make available your content in connection with providing and promoting the service.
By submitting content you represent and warrant that: (a) you own or have the necessary rights to submit it; (b) the content does not infringe any third-party intellectual property, privacy, or other rights; and (c) the content is accurate to the best of your knowledge.
PullPilot may remove or disable any user-generated content at its sole discretion, with or without notice, for any reason including violation of these Terms or community harm.
PullPilot awards points, in-app credits, trust scores, and tier badges as part of its community engagement system. You acknowledge that:

The PullPilot Chrome Extension is provided solely to help you check PullPilot reports while browsing picknpull.com.
You may not use the extension to:
The extension is provided as-is and may stop functioning at any time due to changes at picknpull.com or Chrome. PullPilot makes no service-level commitments for the extension.
You may delete your account at any time via Settings → Delete Account. Deletion triggers a 365-day soft-delete window during which you can reactivate your account. After 365 days, your personal information (email, username, hashed password, OAuth IDs) is permanently anonymised. Reports you submitted are anonymised ("Deleted User") but retained as community knowledge.
PullPilot may terminate or suspend your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or any other reason at our discretion. In the event of account termination for cause, all accumulated points, credits, and earned rewards are forfeited immediately. PullPilot will make reasonable efforts to notify users of suspension or termination at the email address on file, but is not obligated to provide advance notice.
Upon termination, your right to use PullPilot ceases immediately. The license you granted PullPilot in §5 survives termination in anonymised form.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of PullPilot (including questions about the existence, validity, or termination of these Terms) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND PULLPILOT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable for any claim, then the arbitration agreement shall not apply to that claim, and it shall be litigated in court. All other claims remain subject to arbitration.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out" and your full name and email address. Opting out does not affect your ability to use PullPilot.
The following disputes are excluded from arbitration and may be pursued in court: (a) claims that qualify for small-claims court; (b) either party's right to seek injunctive or other equitable relief in court for actual or threatened infringement of intellectual property rights or for unauthorised access to systems.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, excluding its conflict-of-laws principles. For any dispute that is excluded from arbitration under §13, you and PullPilot consent to exclusive jurisdiction and venue in the state and federal courts located in Orange County, California.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
These limitations do not apply to the extent prohibited by law (e.g., gross negligence, willful misconduct, or liability that cannot be limited under applicable consumer-protection law).
You agree to defend, indemnify, and hold harmless ChienTech, its officers, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of PullPilot in violation of these Terms; (b) your user-generated content; or (c) any claim that your content infringes a third party's rights.
PULLPILOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
If you believe that content on PullPilot infringes your copyright, you may submit a written takedown notice to our designated agent. A valid notice must include all of the following:
If content you submitted was removed in response to a copyright takedown notice and you believe the removal was in error, you may send a written counter-notice to our designated agent within 10 business days of the removal. A valid counter-notice must identify the removed material and its prior location, include a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and include your contact information and signature. Upon receiving a valid counter-notice, we will restore the removed content within 10–14 business days unless the complaining party obtains a court order preventing restoration.
PullPilot will suspend or terminate the accounts of users who are subject to multiple valid copyright takedown notices, in accordance with our repeat-infringer policy.
