This End User License Agreement ("EULA") governs your use of all PullPilot software products, including: the iOS application (available on the Apple App Store), the Android application (available on Google Play), the web Progressive Web App (PWA) at pull-pilot.com, and the Chrome browser extension for *.picknpull.com (collectively, the "Licensed Application"). This EULA and the Terms of Service together govern your use of PullPilot.
By downloading, installing, accessing, or using any part of the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not install or use the application.
You and we acknowledge that this EULA is concluded between you and ChienTech only, and not with Apple. Apple is not a party to this Agreement. ChienTech, not Apple, is solely responsible for the Licensed Application and the content thereof. (See Platform Addenda for Apple App Store-specific and Google Play-specific terms.)
Subject to your compliance with this EULA, ChienTech grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to: (a) download, install, and use the PullPilot iOS or Android app on a device you own or control; (b) access and use the PullPilot web PWA at pull-pilot.com through a compatible browser; and (c) install and use the PullPilot Chrome browser extension — in each case solely for your personal, non-commercial purposes and in accordance with this EULA and, where applicable, the Usage Rules of the Apple App Store or Google Play.
You must be at least 16 years old to use PullPilot. By installing or using the Licensed Application, you represent that you are 16 years of age or older. If you are under 16, do not use this application. See also §2 of the Terms of Service.
You may not:
The Licensed Application requests access to your device camera. Camera access is required solely for scanning VIN barcodes using the ZXing on-device image processing library. No video frames, images, or camera output are transmitted to PullPilot servers. Only the decoded 17-character VIN string is sent to our API after you confirm the match. You may revoke camera permission at any time in your device Settings; doing so will disable the barcode scanning feature but all other app features will continue to work.
The Licensed Application may request permission to send push notifications. This permission is optional. If granted, notifications are used for: bounty alerts, report vote updates, support message replies, and gamification milestones. You can disable push notifications at any time in your device Settings → Notifications → PullPilot. You can also manage notification categories individually in Settings → Notifications within the app.
Location access is optional and is used only for the bounty geofencing feature (verifying that you are at a specific junkyard before accepting a bounty reward). Location is not stored persistently. You may revoke location permission at any time in your device Settings; this will disable the bounty geofencing check only.
The PullPilot mobile applications are built with Capacitor, a hybrid application framework. The app's user interface is rendered inside the operating system's native WebView component (WKWebView on iOS; Android WebView on Android). This architecture is a standard and widely used approach for cross-platform mobile application development. The app's functionality and security are equivalent to other mobile applications.
Use on older operating system versions is not supported. PullPilot recommends keeping your operating system updated to the latest available version for security and compatibility.
You retain ownership of all content you submit through the Licensed Application ("Your Content"), including part condition reports, photographs, notes, votes, and bounty submissions. By submitting Your Content, you grant ChienTech a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, modify (for technical formatting and accessibility), distribute, and make available Your Content solely in connection with providing and promoting the PullPilot service.
By submitting Your Content you represent and warrant that: (a) you own or have the necessary rights to submit it; (b) Your Content does not infringe any third party's intellectual property, privacy, or other rights; and (c) Your Content is accurate to the best of your knowledge. The full user content license terms are set out in Terms of Service §5, which is incorporated herein by reference.
ChienTech may remove or disable any user-generated content at its sole discretion, with or without notice, for violation of these terms or for community harm.
In addition to the License Restrictions in §4, you may not use the Licensed Application to:

The Licensed Application and all its content, features, and functionality (including but not limited to all source code, object code, software, text, photographs, graphics, and video) are owned by ChienTech or its licensors and are protected by United States and international intellectual property laws. Nothing in this EULA transfers any ownership of intellectual property to you. Your only right is the limited license expressly granted in §2.

THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
PULLPILOT DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. PART AVAILABILITY DATA IS CROWDSOURCED AND PROVIDED WITHOUT ANY ACCURACY GUARANTEE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIENTECH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THIS EULA OR YOUR USE OF THE LICENSED APPLICATION SHALL NOT EXCEED THE GREATER OF (a) USD $100 OR (b) ONE US DOLLAR (USD $1.00) — as no monetary consideration is exchanged for the free service. IN NO EVENT SHALL CHIENTECH BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
These limitations do not apply to the extent prohibited by applicable law.
This EULA is effective until terminated. Your rights under this EULA terminate automatically and without notice if you fail to comply with any of its terms. Upon termination you must cease all use of the Licensed Application and delete all copies from your devices. Provisions that by their nature should survive termination (including §13, §15, §16, and the platform addenda) shall survive.
You may terminate this EULA at any time by deleting the Licensed Application from all your devices and, if applicable, deleting your PullPilot account.
This EULA shall be governed by the laws of the State of California, United States, excluding its conflict-of-laws principles, subject to the arbitration agreement in the Terms of Service §13.
Notwithstanding the foregoing, residents of the European Union, European Economic Area, or United Kingdom retain the rights provided by their local consumer protection laws and may bring claims in the courts of their country of residence. The mandatory arbitration provisions of the Terms of Service do not apply to EU/EEA/UK residents.
You and ChienTech acknowledge that this EULA is concluded between you and ChienTech only, and not with Apple. Apple is not a party to this Agreement. ChienTech, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA may not provide for usage rules that are less restrictive than the Apple Media Services Terms and Conditions; the more restrictive terms apply.
The license granted to you is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may not use the Licensed Application on any Apple device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.
ChienTech is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA and as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund any amounts paid for the Licensed Application to you (if any) — the Licensed Application is free of charge, so no refund amount is expected. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ChienTech's sole responsibility.
ChienTech, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of HealthKit and HomeKit frameworks (if applicable).
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes a third party's intellectual property rights, ChienTech, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You and ChienTech acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
This EULA, together with the Google Play Terms of Service, governs your use of the Android version of the Licensed Application. ChienTech is solely responsible for the Licensed Application and its content. Google LLC and Google Play are not parties to this EULA and bear no liability for the Licensed Application. In the event of any conflict between this EULA and the Google Play Terms of Service, the more restrictive terms apply.

By uploading any photo through the Licensed Application, you represent and warrant that:
You agree to defend, indemnify, and hold harmless ChienTech, its officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from any third-party claim that your uploaded content infringes a third party's copyright or other intellectual property rights. This indemnification obligation supplements (and does not replace) the general indemnification in Terms of Service §16.
